By accessing our store and placing an order with GABE™ Port Dunford, you agree to be bound by the following terms and conditions. Please read them carefully before making a purchase.

Use of Our Store

Our store is intended for personal, non-commercial use only. You agree not to misuse our platform, attempt to gain unauthorised access, or engage in any conduct that disrupts the operation of our services. We reserve the right to refuse service or cancel orders at our discretion.

Product Accuracy

We make every effort to ensure that product descriptions, images, and pricing are accurate and up to date. However, GABE™ Port Dunford reserves the right to correct any errors and to amend or withdraw products without prior notice. Colours displayed may vary slightly depending on screen calibration.

Pricing & Payment

All prices are listed in South African Rand (ZAR) and are inclusive of VAT where applicable. Payment is required in full at the time of order placement. We accept major payment methods as listed at checkout. Orders will only be processed upon successful payment confirmation.

Intellectual Property

All content featured on the GABE™ Port Dunford platform, including but not limited to brand assets, photography, copy, and design, is the exclusive intellectual property of GABE™ Port Dunford. Reproduction or use of any content without prior written consent is strictly prohibited.

Limitation of Liability

To the fullest extent permitted by applicable law, GABE™ Port Dunford shall not be held liable for any indirect, incidental, or consequential damages arising from the use of our products or services. Our total liability in any matter shall not exceed the value of the order in question.

Governing Law

These terms are governed by the laws of the Republic of South Africa. Any disputes arising shall be subject to the exclusive jurisdiction of the South African courts.

GABE Port Dunford™ Affiliate Programme Terms

1. Enrollment

Participation in the GABE Port Dunford™ Affiliate Programme is subject to approval. We reserve the right to reject any application for any reason, including platforms or content that promote illegal, offensive, discriminatory, or inappropriate material that does not align with the GABE Port Dunford™ brand values.

2. Commission Structure

We offer a tiered commission structure based on performance:

Standard Tier: 20% commission per completed sale.
Advanced Tier: 25% commission per completed sale.
Progression: An affiliate qualifies to advance to the 25% tier once they have successfully completed 150 orders at the 20% rate.

3. Qualified Sales

A "Completed Sale" is defined as a transaction where payment has cleared, the product has been delivered to the customer, and the 14-day replacement window has passed without a return or dispute.

Commissions are calculated on the product sale price only; they are not earned on shipping costs, taxes, or any additional fees.

Since GABE Port Dunford™ operates a "No Refund / Replacement Only" policy, commissions are generally secured once the replacement window expires.

3.1 Cookie & Attribution

Cookie Duration: A 30-day cookie window applies from the customer's last click on your affiliate link.
Attribution Model: Last-click attribution applies. The most recent affiliate link clicked before purchase receives the commission.
Tracking: Commissions are credited only when the customer makes a purchase using your unique tracking link.

4. Payouts

Minimum Threshold: A minimum balance of R600 (six hundred South African Rand) is required for a payout to be triggered.
Payout Window: Payouts are processed starting from the 30th of the current month until the 14th of the following month, provided the affiliate has met the minimum threshold.
Responsibility: Affiliates are responsible for providing correct banking details and managing any personal taxes or banking fees associated with their earnings.

4.1 Payment Method & Currency

Currency: All payouts are made in South African Rand (ZAR) .
Method: Payments are made via EFT to a valid South African bank account.
International Affiliates: Affiliates outside South Africa bear any currency conversion or cross-border transfer fees.
Incorrect Details: If an affiliate provides incorrect banking details, GABE Port Dunford™ is not liable for misdirected payments. A R150 administration fee may be charged to reprocess the payout.

5. Promotion Restrictions

No Spam: Affiliates may not use "spam," unsolicited commercial emails, bulk messaging, or aggressive DM tactics.
Brand Integrity: Affiliates must not misrepresent GABE Port Dunford™ or make false claims about product results, ingredients, or availability.
Paid Ads: Affiliates may not bid on branded keywords (e.g., "GABE Port Dunford," "Port Dunford," or common misspellings) in search engine marketing (Google Ads / Bing) without explicit written consent.

5.1 Affiliate Disclosure (Legal Requirement)

Affiliates must clearly and conspicuously disclose their affiliate relationship with GABE Port Dunford™ in line with consumer protection laws. Acceptable disclosures include:

Using #ad, #affiliate, or #sponsored on social media.
A clear written disclaimer (e.g., "I earn a commission on purchases made through links in this post") on blogs or YouTube videos.

5.2 Prohibited Channels

Affiliates are not permitted to promote via:

Coupon or voucher websites (unless explicitly approved in writing).
Direct link shortening services that obscure the tracking link. (Standard Bitly links are allowed provided no other affiliate's link is inserted.)
Fake review sites or paid traffic sources that violate platform terms.

6. Termination

Notice Period: Either party may terminate the affiliate relationship at any time with 7 days' written notice via email.
Fraudulent Activity: Fraudulent activity—including self-referrals to bypass pricing, using stolen credit cards, click fraud, or falsifying information—will result in immediate termination and forfeiture of all unpaid commissions.
Post-Termination Obligations:
- Logos & Trademarks: Upon termination, the affiliate must remove all GABE Port Dunford™ logos and trademarks from their platforms within 7 days.
- Tracking Links & Content: Existing text links or review content may remain, but affiliate tracking links must be removed or replaced with non-affiliate direct links (which will earn no commission). Standard hyperlinks to gabeportdunford.co.za are permitted.
- Fraud or Violation Termination: For affiliates terminated due to fraud or violation of Section 5 (Promotion Restrictions), all links, banners, and brand references must be removed entirely within 48 hours.
Final Payout: Commissions earned before the effective termination date will still be paid in the next payout cycle, provided they meet the minimum R600 threshold.

7. Force Majeure

GABE Port Dunford™ will not be liable for delayed or missed payouts, tracking errors, or service interruptions due to events outside reasonable control, including but not limited to: load-shedding, banking system failures, internet outages, natural disasters, or government action.

8. Amendments

GABE Port Dunford™ reserves the right to update or modify these terms at any time.

Affiliates will receive 14 days' notice via email of any material changes.
Continued participation after the effective date of changes constitutes acceptance of the revised terms.

9. Governing Law & Disputes

These terms are governed by the laws of the Republic of South Africa. Any disputes arising from this agreement shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes may be referred to arbitration or the appropriate court in KwaZulu-Natal, South Africa.
